Welcome to Swishables. These Terms and Conditions (the “Terms”) describe the terms and conditions applicable to your access and use of the website at getswishables.com (the “Site”). This document is a legally binding agreement between you as the user of the Site (referred to as “you,” “your,” or “User”) and Stomacare Inc, doing business as Swishables (referred to as “we,” “our,” “Swishables,” or the “Company”).

Stomacare Inc is a Delaware corporation with its principal place of business at 757 East Brokaw Road, San Jose, CA 95112.

1. Acceptance of Terms

1.1 By accessing the Site or purchasing any Swishables products or services (collectively, the “Services”), you agree to be bound by these Terms, our Privacy Policy, and any additional rules or policies published on the Site. If you do not agree to all of these Terms, please do not use the Site or purchase our products.

1.2 You may not use the Services or accept these Terms if (a) you are not of legal age (at least 18 years old) to form a binding contract, or (b) you are not permitted to receive the Services under the laws of the jurisdiction in which you reside or from which you access the Site.

1.3 We reserve the right to update or modify these Terms at any time by posting the revised version on the Site. Your continued use of the Site or Services after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

2. Products & Services

2.1 Swishables offers pre-filled liquid mouthwash conveniently packed in pocket-size, single-use sachets. Our products are designed to provide on-the-go oral care and are available for purchase through the Site.

2.2 Product descriptions, images, pricing, and availability on the Site are subject to change without notice. We make reasonable efforts to display product information accurately, but we do not guarantee that descriptions, images, pricing, or other content on the Site are error-free, complete, or current.

2.3 We reserve the right to limit quantities, refuse orders, or discontinue any product at any time and for any reason.

2.4 For bulk or wholesale inquiries, please contact us at contact@getswishables.com. Bulk and wholesale orders are subject to a separate agreement and may include different pricing, terms, and minimum order quantities.

3. Ordering & Payment

3.1 When you place an order through the Site, you agree to provide accurate, current, and complete information, including billing and shipping details. We reserve the right to cancel or suspend any order if we suspect inaccurate, fraudulent, or incomplete information.

3.2 All prices listed on the Site are in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges will be calculated and displayed at checkout.

3.3 Payment must be made at the time of purchase using an accepted payment method as displayed on the Site. By submitting payment, you represent and warrant that you are authorized to use the payment method provided.

3.4 Your order is not confirmed until we send you an order confirmation email. We reserve the right to decline or cancel any order at our discretion, including orders that appear to involve resale or unauthorized distribution.

4. Subscription Plans

4.1 Swishables may offer subscription-based purchasing options. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis at the frequency and price indicated at the time of enrollment.

4.2 Subscription pricing, discounts, and promotional offers (including the Quarterly Supply plan) are subject to change. We will provide reasonable notice of any pricing changes before they take effect on your next billing cycle.

4.3 You may cancel, pause, or modify your subscription at any time by logging into your account or contacting customer service at contact@getswishables.com. Cancellations will take effect at the end of the current billing period.

4.4 Promotional pricing (such as discounted first-quarter rates) applies only to the initial qualifying period. After the promotional period ends, your subscription will renew at the standard price unless you cancel prior to renewal.

5. Shipping & Delivery

5.1 We currently ship within the United States only. We are working on expanding internationally—sign up for our newsletter to be notified when international shipping becomes available.

5.2 Orders typically ship within one (1) business day of placement. Delivery times depend on your selected shipping method and location. We offer Standard shipping (2–5 business days) and Expedited shipping (1–2 business days). Shipping rates are displayed at checkout.

5.3 Once your order is shipped, you will receive a confirmation email with tracking information. Risk of loss and title for products pass to you upon delivery to the carrier.

5.4 If your order arrives damaged or fails to arrive, please contact us at contact@getswishables.com within seven (7) days of the estimated delivery date. We will work with you to replace or refund the affected order.

6. Returns, Refunds & Satisfaction Guarantee

6.1 We offer a 90-day satisfaction guarantee. If you are not satisfied with your purchase, contact us at contact@getswishables.com within 90 days of delivery, and we will issue a full refund—no questions asked. You are not required to return the product in order to receive your refund.

6.2 To initiate a refund, please email us with your order number and reason for the request. Refunds will be processed to the original payment method within 5–10 business days of approval.

6.3 We reserve the right to modify or discontinue the satisfaction guarantee at any time. Any changes will apply to orders placed after the modification date.

7. Product Safety & Usage

7.1 Swishables products are intended for oral care use only. Tear open the sachet, swish the liquid in your mouth for 15–30 seconds, and spit it out. Do not swallow.

7.2 Our products are dye-free and alcohol-free. Ingredients include: Water, sorbitol, sodium benzoate, sodium saccharin, benzyl alcohol, menthol lactate, menthol, PEG-35 castor oil, PEG-50 hydrogenated castor oil, xylitol, cetylpyridinium chloride, PEG-40 hydrogenated castor oil, and sodium citrate. Our products do not contain fluoride.

7.3 Keep out of reach of children under the age of 6. If you have specific oral health concerns or conditions, consult your dental professional before use.

7.4 Store in a cool, dry place. Shelf life is three (3) years from the date of manufacture.

7.5 Swishables are TSA-approved and safe for travel. They are not intended to replace brushing, flossing, or regular dental checkups.

8. User Accounts

8.1 Certain features of the Site may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

8.2 You agree to provide accurate and complete information when creating your account and to update your information promptly if it changes.

8.3 We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms or engaged in fraudulent or unauthorized activity.

9. Intellectual Property

9.1 All content on the Site—including text, graphics, logos, images, product designs, and software—is the property of Stomacare Inc (DBA Swishables) or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 “SWISHABLES,” the Swishables logo, and related marks are trademarks or registered trademarks of Stomacare Inc. You may not use any of our trademarks without prior written consent.

9.3 You may not copy, reproduce, distribute, modify, display, or create derivative works from any content on the Site without our express written permission.

10. User Content

10.1 By submitting any content to the Site—including reviews, testimonials, photos, or other materials (“User Content”)—you grant Swishables a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, display, and distribute such content in connection with our business, including marketing and promotional purposes.

10.2 You represent and warrant that you own or have the necessary rights to submit any User Content and that it does not violate any third-party rights or applicable laws.

10.3 We reserve the right to remove any User Content at our discretion without notice.

11. Prohibited Conduct

11.1 You agree not to use the Site or Services to: (a) violate any applicable law, regulation, or third-party rights; (b) submit false, misleading, or fraudulent information; (c) interfere with or disrupt the integrity, security, or performance of the Site or its underlying systems; (d) attempt to gain unauthorized access to the Site, user accounts, or computer systems; (e) use the Site for any commercial purpose not expressly authorized by Swishables, including reselling products without our consent; or (f) use automated systems (bots, spiders, scrapers) to access or collect data from the Site without our written permission.

12. Third-Party Links

12.1 The Site may contain links to third-party websites or services that are not owned or controlled by Swishables. We are not responsible for the content, privacy practices, or policies of any third-party sites.

12.2 Your use of third-party websites is at your own risk, and we encourage you to review the terms and privacy policies of any third-party site you visit.

13. Disclaimer of Warranties

13.1 THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13.2 WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13.3 SWISHABLES PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. RESULTS MAY VARY. CONSULT YOUR DENTAL PROFESSIONAL FOR SPECIFIC ORAL HEALTH ADVICE.

14. Limitation of Liability

14.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWISHABLES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

14.2 IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO SWISHABLES FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14.3 THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF SWISHABLES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

15.1 You agree to indemnify, defend, and hold harmless Swishables, Stomacare Inc, and their respective officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you submit.

16. Privacy

16.1 Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy.

17. Governing Law & Dispute Resolution

17.1 These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

17.2 Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the State of Delaware. You consent to the personal jurisdiction of such courts.

17.3 Before filing any claim, you agree to first contact us at contact@getswishables.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any concern within thirty (30) days of receipt.

18. Force Majeure

18.1 Swishables shall not be liable for any delay or failure in performance resulting directly or indirectly from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or infrastructure failures, strikes, shortages of materials, or any other event of force majeure.

19. Severability

19.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

20.1 These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Swishables regarding your use of the Site and Services, superseding any prior agreements or understandings.
